Ellen DeGeneres, Walmart Sued by Artist Over EV1 Apparel Line - Hollywood Reporter Posted: 30 Jul 2019 11:33 AM PDT "Nothing is more antithetical to a street artist's credibility than association with mass-market consumerism — of which Walmart is the epitome." Walmart and Ellen DeGeneres are being sued over their collaborative EV1 line by a New York artist who doesn't love their alleged use of his design. Julian Rivera on Monday filed a copyright infringement lawsuit against the retail giant and the talk show icon, claiming his "love" design was copied without permission on the clothing. The artist says he has carefully avoided association with corporate culture and has diligently controlled distribution of his work in order to protect his reputation. "Despite offers, he has very rarely made his original art available as part of corporate advertising campaigns — partly for artistic reasons but also because doing so would diminish the value of his work," writes attorney Jeffrey Gluck in the complaint. "Indeed, nothing is more antithetical to a street artist's credibility than association with mass-market consumerism — of which Walmart is the epitome. People who recognized his Design in the EV1 Collection would have concluded that Rivera "sold out," diminishing the value of his work and reputation." Rivera says he sent a cease and desist letter to Walmart in May, and in July the retailer's lawyers "asserted that it had not copied the Design, that its own graphic was quite different, and that the Design was only minimally creative." Rivera is suing for copyright infringement and unfair competition, and is seeking monetary damages and an order that the retailer must recall any infringing products from the marketplace. The full complaint, which contains a comparison of the designs, is posted below. The Hollywood Reporter has reached out to DeGeneres for comment. A Walmart spokesman sent THR this statement: "Walmart is an intellectual property owner and respects the intellectual property rights of others. Once we are served with the complaint, we will respond appropriately with the court." July 30, 12:40 p.m. Updated with a statement from Walmart. |

Logo supporting Diemel family turns into an apparel fundraiser - WBAY Posted: 30 Jul 2019 02:16 PM PDT HORTONVILLE, Wis. (WBAY) – A logo that was made in honor of Nick and Justin Diemel and shared countless times on social media is coming to life in the form of a fundraiser to help the family. ![]() "I posted it on my social media, just to kind of show my support and it took off and I didn't think it would get to multiple states and nationwide, and I mean it's amazing how much support they're getting from it," said Jeremy Lee, who grew up in Bonduel and knew Nick Diemel. Jeremy Lee made the logo to support the Diemel family and having grown up in Bonduel, he knew Nick Diemel both personally and professionally. He never expected his sketch to grow so popular. "Jeremy contacted me on Saturday and he contacted me with this logo design and asked if I would help him create an online store to make a fundraiser for the Diemel family," said Jill Kramer, owner of Fox Cities Embroidery. The idea has already gone viral with hundreds of orders placed in less than 24-hours in several states. All of the proceeds will go to the Diemel family. "I think it's great that the community, actually the nation, has really embraced this and are really doing everything they can to help their family," said Kramer. Lee said he isn't surprised by the outpouring of support for a family that gives back when they can and is beloved in the community. He hopes this fundraising effort helps spread the message so that people continue to think about the Diemel family. CLICK HERE to purchase Diemel Brothers apparel and accessories for the fundraiser. Orders will be accepted from now until midnight on August 4th. |
